Halogen’s dedication to providing great value and addressing the specific talent management needs of its clients has been demonstrated in its launch of two industry-first features at the SHRM Conference in June -– the Halogen Talent Profile feature and Activity Tracker. Both are designed to help HR with real-world issues they face in the deployment and ongoing administration of their talent management systems.

With the first customizable Talent Profile (http://www. halogensoftware. com/news-events/wp_pr. php? type=pr&p=1184), Halogen helps solve low usage, limited security, and flexibility problems associated with conventional employee profiles. Halogen’s Activity Tracker (http://www. halogensoftware. com/news-events/wp_pr. php? type=pr&p=1189) provides the industry’s first consolidated real-time “status update” feed of all talent management activity for users of the system. Using a familiar social networking interface, the feature is built to drive user adoption of talent management within the organization and deliver time savings for HR, management and employees. Both the Talent Profile solution and Activity Tracker feature will be delivered at no additional cost, fully integrated with Halogen’s talent management suite 9.1, currently scheduled for release in September.

In addition to these unique features, Halogen teamed with an industry leader, SkillSoft, announcing an agreement to deliver 10 SkillSoft e-learning courses as a standard component of Halogen eLearning Manager™. The agreement provides outstanding value to corporate learning centers and a truly seamless user experience for performance-based e-learning.

Dirty Avocados Adventure Racing is raising money for the Make-A-Wish Foundation® of Sacramento and Northeastern California. The Dirty Avocados will be sending two four-person teams to July 2008's Primal Quest Expedition Adventure race and will use Primal Quest as a platform to raise money to grant a special wish for a local child.

According to Adam Doti, one team's captain and a father of two young boys, "We are so blessed to have our health and to be able to participate in adventure racing. We are living our dream. We just believe that we should use this forum to help kids achieve their dreams."

Several of the Dirty Avocados have young children. "We are so fortunate to have healthy children and to be able to provide for them. Not all kids are so lucky. We just want to help" said Mike Chastaine, father of three girls, and the captain of the second Dirty Avocados team.

While Primal Quest is still nine months away, the Dirty Avocados are well into their fundraising and training. A component of the fundraising will be raffles for outdoor and sports gear and services donated generously by local companies. New Book Suggests a Ten-Step Reconstruction Plan for America’s Dysfunctional Health Care System

New Book Suggests a Ten-Step Reconstruction Plan for America’s Dysfunctional Health Care System

E. Stanley Kardatzke’s Xlibris release is a timely book addressing an ongoing crisis

(Vocus/PRWEB) December 07, 2010

Zionsville, IN– December 7, 2010 – For over forty-five years, author E. Stanley Kardatzke, M. D. has witnessed the marvelous improvements in medical technology. However, parallel to these developments is the increasing number of patients denied basic health care because of no health insurance. In his new book, DECISIVE REFORM for OUR DYING HEALTH CARE SYSTEM, he addresses the dysfunctional U. S. health care system by proposing concrete plans of action.

“The United States health care system is critically ill,” the author says. Although he acknowledges that many experts tend to blame a particular component in the health system (hospitals, physicians, insurance companies, and attorneys, etc.), he believes that the illness is not due to the component members of the system. It is due to the inherently wrong incentives, which are woven into the current system.

In this book, Dr. Kardatzke documents the causes of the health care crisis and suggests a ten-step reconstruction plan, which he attests, if enacted this year, would solve problems of access to health care for all while reducing – not increasing – health care costs by 2011.

“I have been at the top of our health care system as a CEO of a very large Health care company, and I also have been a family doctor, and now I am again an emergency physician. This book suggests simple methods for solving the current Health Care Reform debate and giving the uninsured health coverage while still saving billions annually,” the author says.

He has seen the problems of our health care system from many view points. He writes this book from his depth of experience as a physician, businessman, church leader, and student of health economics. This book is for lawmakers, health regulators, employers, physicians, and all Americans who want to solve our nation’s health care crisis.

New Poll Asks Which TV Character Would Be Worst Babysitter

New Poll Asks Which TV Character Would Be Worst Babysitter

The Smart Television Alliance (STA) is asking TV viewers who would they least want to babysit their kids - Homer Simpson, Hank Hill or Peter Griffin? The purpose of the survey is to get parents to think about the shows their children watch and promote healthy, educational programming that is age-appropriate.

Washington, DC (PRWEB) July 30, 2008

Irresponsible, careless, naive or incompetent are hardly the characteristics you would want in someone supervising your children, but some of the most well-known parents on TV possess these exact traits. Who would you least want to babysit your kids - Homer Simpson, Hank Hill or Peter Griffin? (http://www. smarttelevisionalliance. org/site/PageNavigator/Alliance%20Site%20Summer%20Pledge/Summerspike_Quizland)

That is the question the Smart Television Alliance (STA) is asking TV viewers to answer in a recently launched poll. In addition, people can also post comments about their answers on the STA blog. The purpose of the survey is to get parents to think about the shows their children watch and promote healthy, educational programming that is age-appropriate.

"With children spending an average of four hours in front of the TV everyday, it's critical that parents try to make that time as constructive as possible through educational and inspiring programming," stated Christopher Turman of the Smart Television Alliance. "STA has partnered with media experts such as KIDSFIRST! and Common Sense Media, among others, to highlight some of the best shows on TV today."

STA believes it's important to: (1) provide parents and caregivers with resources and action steps to control what is watched on television and when; (2) partner with the producers of expert-recommended shows to highlight educational programming; (3) provide children's television recommendations from trusted media experts; and (4) enlist parents and others to spread the word to their friends and acquaintances.

About Smart Television Alliance (http://www. SmartTelevisionAlliance. org) (STA)
The Smart Television Alliance is a new coalition of national nonprofit organizations united by a shared commitment to improving what our nation's children watch on television. Our mission is to help parents and caregivers use technology, online tools, and program recommendations from trusted children's media experts to make smart television viewing choices. By promoting the viewing of educational and informational programming, STA will build a market for more high quality children's TV shows.

(PRWEB) June 13, 2002

George L. Graziadio, Jr., co-founder of Imperial Bank and a generous benefactor to many charities and universities, including Pepperdine UniversityÂ’s Graziadio School of Business and Management, succumbed to a long struggle with cancer on June 6 at his home on the Palos Verdes Peninsula with his family present.

“In losing Mr. Graziadio we have lost a much-loved member of the Pepperdine family,” noted Pepperdine president Andrew K. Benton. “His vision and leadership propelled the Graziadio School to a preeminent position among business school worldwide. He has had a profound impact at Pepperdine and he will be missed in countless ways.”

Mr. Graziadio was a tireless entrepreneur, banker and community sponsor who lived his motto: “TNT – Today, Not Tomorrow.” He was often quoted as saying that he was constantly driven to do more and to always do better. He believed that if better was possible, then good was not enough.

Mr. Graziadio was a legendary real estate developer and banker in Southern California for more than 50 years. The Vernon, Connecticut, native came to California during World War II and in the early 1950s formed a real estate development company with George Eltinge. The “Two Georges,” as they were known, developed shopping center properties throughout the United States.

In 1963, with $1.25 million in private investment and a belief that they could offer the Los Angeles business community a better “business bank,” Mr. Graziadio and Mr. Eltinge formed Imperial Bank, which became Imperial Bancorp in 1968. The bank grew to $8 billion in assets, solely through internal growth and without acquisitions, with $600 million in capital and reserves. Imperial Bank had a national presence in emerging growth industries in the 1990s with offices in Phoenix; Boston; Austin; Dallas; Denver; Reston, Virginia; Raleigh/Durham, North Carolina; and Kirkland, Washington. Imperial Bank’s entertainment division was the largest financer of feature motion pictures in the world. Mr. Graziadio served as chairman of the board, CEO and president. Former California governor Goodwin J. Knight served on the original bank board of directors.

In November 2000, Imperial Bancorp merged with Comerica, Inc. in an exchange of shares valued at $1.3 billion. The combined assets are now approximately $50 billion with market capital at approximately $11 billion. Mr. Graziadio was serving as Chairman of Comerica Bank-California until his death.

He was past president and founding director of the Torrance Memorial Medical Center Health Care Foundation where the radiology center is now named the Graziadio Radiology Center. In 1996, Pepperdine University renamed its business school the George L. Graziadio School of Business and Management following the largest business school endowment in America at the time by Mr. Graziadio and his wife Reva. Mr. Graziadio created the Graziadio School Board of Visitors and served as its chairman.

The Graziadio School is the largest business school west of Chicago and is ranked among the Top 20 in the nation for its Executive MBA and Fully Employed MBA programs. More than 2,300 mid-career business professionals currently attend The Graziadio School at seven campuses throughout California.

During the past five decades, Mr. Graziadio had been honored by dozens of non-profit organizations that he supported philanthropically. He often said, “You earn your living by working, your earn your life by giving.” In April 2002, he received the prestigious Horatio Alger Award in Washington, D. C., joining other great Americans such as President Dwight D. Eisenhower, Secretary of State Colin Powell, Senator Robert Dole, and Oprah Winfrey. His many honors include: The Ellis Island Medal of Freedom; the Grande Ufficiale Award in the Order of Merit of the Republic of Italy; Americanism Award and the Good Scout Award from the Boy Scouts of America; the Eddy Award from the Los Angeles Economic Development Agency; the President’s “E” Award from the U. S. Department of Commerce; the Albert Schweitzer Leadership Award from the Hugh O’Brian Youth Foundation; and honors from the Provence of Puglia, Italy, Newcomen Society, Pepperdine University, B’nai B’rith Foundation, National Italian American Foundation, the Center for the Partially Sighted, the Sons of Italy of America, the Muscular Dystrophy Association, the House Ear Institute, and a Doctor of Humane Letters from Chapman University.

Mr. Graziadio served as a member and director of many organizations, including: 20-30 Clubs, World Council of Young MenÂ’s Service Clubs, University of Southern California Associates, Pepperdine University Associates, the Anderson School Board of Visitors at UCLA, International Council of Shopping Centers, Board of Trustees of the HOBY Foundation, French Foundation for Alzheimer Research, Los Angeles World Affairs Council, GovernorÂ’s Commission of the Californias, the Aero Club of Southern California, Town Hall of California, California BankerÂ’s Association, American BankerÂ’s Association, Independent BankerÂ’s Association, YMCA of Metropolitan Los Angeles, Los Angeles Convention and Visitors Bureau, Delta Mu Delta Honor Society of United States Business Schools, Los Angeles Chamber of Commerce, GovernorÂ’s California Italian American Task Force.

Mr. Graziadio was a passionate golfer and belonged to numerous country clubs, including Bel Air, Rolling Hills, Lake Arrowhead, Indian Ridge, Red Rock Country Club in Las Vegas, Royal Oaks Country Club in Houston, and The Vintage Club. He was one of only a handful of amateurs who played in 30 consecutive Bob Hope Desert Classic golf tournaments.

His wife of 59 years, Reva, two daughters, Mary Lou Area, Alida Calvillo, and one son, G. Louis Graziadio, III, survive Mr. Graziadio. There are nine Graziadio grandchildren and six great grandchildren.

Dietary Doctor Says "Feed Problem Child More Fat"

Dietary Doctor Says "Feed Problem Child More Fat"

If your kids are "bouncing off the walls" or having concentration difficulties at home or school, the advice from a leading dietary doctor is, "Don't give them medication -- feed them more fat at the dinner table."

(PRWEB) August 16, 2004

Dr. Udo Erasmus (http://www. udoerasmus. com/firstscreen. htm), author of the book, "Fats That Heal Fats That Kill" (http://www. florahealth. com/flora/home/international/products/9381.asp), says many behavioral disorders -- even Attention Deficit Hyperactivity Disorder -- are classic symptoms of essential fatty acid deficiencies, and can be successfully treated simply by adding fat-and-oil-rich foods or supplements to the diet.

How would increasing your childÂ’s intake of essential fatty acids (EFAs) lift his or her mood and improve mental performance? Dr. Erasmus explains:

“EFAs are required for brain development and brain function. At 60% fat, the brain is the fat-richest organ in the body. We are fat-heads. It's a compliment. EFAs elevate mood and lift depression; bring calmness (in dogs, cats, horses, children, and adults); improve the ability to deal with stress and reduce the tendency to get stressed; improve focus; improve motor co-ordination; improve strength; speed learning; increase intelligence; improve visual acuity and color perception in older people; calm down hyperactive (ADD and ADHD) kids; make juvenile delinquents unresponsive to counseling counselable; make violent criminals less violent; decrease hallucinations in schizophrenics; improve Alzheimer's and senile dementias.”

"We've been removing fats from foods for years and we're starting to see the damage caused by essential fatty acid deficiency -- especially in children who have been fed low fat foods from infancy," says Dr. Erasmus.

Dr. Erasmus says food makers have created "fat-phobia" in the minds of consumers. But contrary to popular belief, studies now show that eliminating fats from the diet is very unhealthy.

Dr. Erasmus reports essential fatty acid deficiency is easy to reverse by eating foods like mackerel, trout & salmon, free-range eggs, and chicken with skins (never fry or deep fry meat or fish). Flax seeds, sunflower seeds, & safflower seeds are also snacks rich in essential fatty acids.

Perhaps the easiest way parents can ensure their children have adequate fatty acid intake is to give them one or two tablespoons of a fresh seed oil called "Udo's Choice Oil", available in health food stores, but they can also make their own oil combination based on the specifications in the book.

Essential fatty acid deficiency is today's number-one nutritional deficiency -- and recognizing it early and correcting the diet accordingly not only will markedly alter your child's behavior -- it will help shield against blood sugar, weight, immune and circulatory problems later in life.

Hyperactivity, violent behavior, and learning impairment are three of the thirty symptoms of essential fatty acid deficiency reviewed in Dr. Erasmus's book.

The book -- "Fats That Heal Fats That Kill" (http://www. florahealth. com/flora/home/international/products/9381.asp)

"Fats that Heal Fats that Kill" has been hailed as "the first book to make sense out of the role of fats in health. Dr. Erasmus takes the fear and mystery out of fats." (Richard Kunin, MD "President, Society for Orthomolecular Medicine)

Lean Six Sigma Training Simulation Introduced by NOVACES at the National Forum on Quality Improvement in Health Care

Lean Six Sigma Training Simulation Introduced by NOVACES at the National Forum on Quality Improvement in Health Care

The training simulation called MediSim provides hands-on experience during training courses to teach how Lean Six Sigma tools are used to improve patient care processes in hospitals.

New Orleans, LA (PRWEB) December 16, 2009

NOVACES introduced its MediSim simulation package for healthcare performance improvement training as an exhibitor at the National Forum on Quality Improvement, which ran from December 6-9 at the Orlando World Center Marriott Resort & Convention Center. Used during Lean and Six Sigma training, MediSim enables practical application of concepts and tools, such as process mapping, mistake proofing, and visual management. As a result, participants can practice being change leaders in various exercises that are based on real-world scenarios for process improvement in hospitals.

MediSim (http://www. novaces. com/medisim. php) is the latest addition to NOVACES’ portfolio of industry-specific process improvement training tools. From its SystemCPI deployment roadmap (http://www. novaces. com/systemcpi. php) that quickly builds self-sufficiency in process improvement to its customized Lean Six Sigma training for healthcare, the company’s process improvement solutions help healthcare organizations solve their most challenging problems to achieve operational and financial performance goals.

With MediSim, hospitals that are implementing Lean Six Sigma now have an effective teaching tool that can be used in various levels of training including Lean Expert, Green Belt or Black Belt. The simulation significantly reduces the large investment and lead-time required for an organization to develop a custom training simulation. Organizations that use MediSim report increased training effectiveness and buy-in for the process improvement program.

“The real advantage of this simulation is that participants can directly relate to a real healthcare challenge during the training course,” said Master Black Belt Vickie Kamataris of NOVACES (http://www. novaces. com), who developed and tested MediSim. “This simulation allows participants to apply appropriate improvement tools and generate interactive dialogues about topics that are essential to developing very capable Lean Six Sigma practitioners,” Kamataris emphasized.

The MediSim Simulation Kit includes supplies, equipment, training materials, exercises, and on-site facilitator training. MediSim is available for license on an annual unlimited use or per training basis.

NOVACES is a leading provider of continuous process improvement (CPI) consulting and training services to both the public and private sectors. By leveraging over two decades of applied research experience, the company is capable of delivering today's most effective methods for generating breakthroughs in operational capabilities and financial performance. Employing its SystemCPI methodology, the company provides an integrated framework to deploy and manage a process improvement program that incorporates Constraints Management tools to achieve faster and better return on investment.

In this "Our Planet" series, we'll discover innovative ways to meet present needs and improve living standards, without destroying resources needed for the future. Industry leaders and experts will discuss the importance of conservation development, the current issues facing the industry, and the trends that are taking shape to preserve our environment.

They were looking for a special niche in terms of senior housing, something more personal than large corporate assisted living facilities but, at the same time, more refined than the converted homes offered by some "Mom and Pop" operations.

The Stoeckles decided to develop their own special formula and created what they call "Excellence in Senior Care" for their residents. The Open House program for senior citizens on June 29 is representative of that personalized approach, as well as being an example of their goal to be a resource to the community.

Sweet Water at Largo is at 11290 Walsingham Rd., Largo, FL, 33778. It is licensed by the state of Florida Agency for Health Care Administration as an Assisted Living Facility. License # AL8175.

Pandemic Flu Imminent; Healthcare Community Fails to Create Preparedness Plan

Pandemic Flu Imminent; Healthcare Community Fails to Create Preparedness Plan

Addressing the issue of properly treating all patients in a crisis is the first step in creating a realistic plan.

Stanton, CA (PRWEB) September 8, 2006

Avian Flu Talk, announces the launch of its new affiliate website that has now begun selling medical tents to the healthcare community to help medical centers prepare for a pandemic flu.

“The main focus in pandemic flu planning should be in the area of hospital preparedness to ensure that all hospitals are prepared to handle any sudden increase in hospital admissions. Addressing the issue of properly treating all patients in a crisis is the first step in creating a realistic plan. It's important for each medical center to asses its own ability to handle an increase of new patients.” said Ryan Evans, founder of Avian Flu Talk.

The new web portal that sells the medical tents can be viewed at www. Medtents. com. The majority of the proceeds from Medtents will be reinvested into community preparedness.

Earlier this week, Avian Flu Talk posted an awareness advertisement created by Ready. gov in support of National Preparedness Month. National Preparedness Month goes throughout the month of September.

Avian Flu Talk recently announced a recommendation for all citizens to obtain a pneumonia vaccination known as the pneumococcal PPV23. A pneumonia vaccination has the ability to prevent the lethal secondary bacterial infection which can develop as a complication to a severe flu. The most common way to treat the secondary infection is with antibiotics, which would be in short supply during a pandemic. Obtaining a pneumonia vaccination ahead of time is thought to be more effective than using antibiotics to fight the pneumonia infection. Until the emergence of this new super-flu virus, such preventive measures were rarely discussed.

For more information on how to prepare for a possible pandemic flu, we would encourage all of those who have not already done so, to visit this online preparedness discussion forum located at www. Avianflutalk. com.

Cool Pet Products Brought Together for Holiday Shopping

Cool Pet Products Brought Together for Holiday Shopping

Pet Expert Steve Dale has holiday gift ideas that cover everything from traveling with pets, better training methods, even mobility for aging pets, while raising money for charity.

Chicago, IL (PRWEB) November 7, 2010

America’s Pet Expert, Steve Dale, host of the national radio show Steve Dale’s Pet World is using his national radio platform to help promote pet products that are supporting a good cause in time for holiday shopping.

Visitors to Dale’s radio website – petworldradio. net can see top choices for pets on the Cool Pet Products page.

“These companies have some great offerings for pets, covering everything from ways to make travel easier, wonderful enrichment and training toys, even products to help our older and disabled pets live fuller lives,” said Dale.

The companies selected for the Cool Pet Products page have all made a generous donation to the American Humane Association. Dale is a board member at American Humane and feels that these companies recognize the value of American Humane’s mission.

“As the nation’s ‘voice for children and animals’ American Humane is at the forefront of advocacy for our kids and our pets,” said Dale. “The support of these companies means a great deal.”

On the Cool Pet Products page, pet parents can see product videos and find a wealth of information on a variety of products for pets. They can learn how to travel easily with products made by Kurgo, including the Wander Hammock that allows a pet to travel safely in the backseat without spreading hair all over the car.

When pets have to be left behind a Talk To Me Treatball keeps them engaged by working to get treats out of the ball, while also hearing a recording of their pet parent’s voice.

Cloud Star’s Buddy Biscuits are made in the USA with all human-grade ingredients, no by-products and no fillers. Buddy Biscuits are specially formulated for all dogs including those with allergies.

Pets that search for the coolest place to lay can always find their spot with a Cool Pet Pad. This self-cooling cushion cools without refrigeration, water or electricity.

Trupanion makes it possible to provide the best medical care possible for pets with affordable pet health insurance.

An all-natural product for dogs, Stella & Chewy’s frozen and freeze-dried dinners and treats only include ingredients like raw, natural meat and organic fruits and vegetables without added hormones or antibiotics.

Pet breath can be fresher and dental health improved with TropiClean’s line of oral pet care products. Regular use of the Clean Teeth Gel Kit or Mint Foam is as easy as applying to the dog’s teeth and gums and letting their tongue do the rest.

The Pet Corrector is one of many ideas to come from the mind of Dr. Roger Mugford, Britain’s leading behaviorist. The Pet Corrector emits a hiss of air that stops a dog in her tracks, allowing the rewarding of good behavior while stopping bad behavior safely and gently.

Sometimes aging dogs develop back problems that don’t allow them to get around like they did in their younger years. The Pet Mobility Rehab Center has been providing these aging or injured furry family members a better quality of life for over 40 years with their line of doggy wheelchairs.

Dale, whose syndicated columns reach over 16 million people each week said, “I’m always being asked on the radio and in letters to my columns about traveling with our pets, toys that will keep them busy, about training, about keeping their teeth clean, about healthy treats and meals – all of the products we are able to bring together on the Cool Pet Products page can enhance these pets’ lives in some way and now pet parents can find them all in time for the holidays.”

Steve Dale’s Pet World is a national radio program heard on over 55 stations around the U. S. and Canada, syndicated by Black Dog Radio Productions, Inc. Federal and New York State Courts Reaffirm That No Inherent Fiduciary Duty Exists Between Insurance Companies, Brokers and Clients

Federal and New York State Courts Reaffirm That No Inherent Fiduciary Duty Exists Between Insurance Companies, Brokers and Clients

The insurance industry continues to defend itself against lawsuits alleging the existence of a fiduciary duty between insurance companies, insurance brokers and clients. Lisa Shrewsberry, a partner with the New York law firm of Traub Eglin Lieberman Straus, recently defended two such cases in both federal and New York state courts. Both courts agreed with Shrewsberry's argument that under New York law, insurance companies and their representatives generally do not owe a fiduciary duty to those insure. The relationship between insurer or broker and client is a common commercial relationship, even if the company or its broker maintains a long-standing personal relationship with the client.

Hawthorne, NY (PRWEB) September 13, 2006

TRAUB EGLIN LIEBERMAN STRAUS LLP (TELS) is pleased to announce that in two recent cases argued in New York, TELS attorney Lisa L. Shrewsberry was able to uphold the principle that the relationship between an insurance company or its broker and an insured is that of a common commercial relationship, not rising to the level of a fiduciary.

The first case, filed in U. S. District Court, Southern District of New York, alleged misconduct by TIAA-CREF and its related entities in the sale of a single life annuity to a 70 year-old university professor. The professor, who suffered from severe emphysema, retired with approximately $1.3 million in retirement benefits. After retirement, the professor decided to purchase a single life annuity without a guaranteed payout period or death benefit. Such an annuity provides greater monthly income than similar annuities with those features built-in. Approximately six months after retirement, the professor passed away.

The executrix of the professor's estate subsequently sued TIAA-CREF, alleging that the insurance company should have prevented the professor from purchasing that type of annuity. In light of her deteriorating health, the suit alleged, TIAA-CREF should have recognized that the annuity was not in her best interests. The Plaintiff also alleged that the issuer of the annuity recognized a substantial windfall upon the death of the annuitant (the professor), and that they breached a fiduciary duty by selling the annuity contract to her.

Lisa Shrewsberry of TELS then filed a motion to dismiss for failure to state a claim upon which relief might be granted. In the motion, Ms. Shrewsberry argued that, under New York law, insurance companies and their representatives generally do not owe a fiduciary duty to those they insure. While a fiduciary duty can be created, even in certain arms-length transactions, an active attempt by the insurance company to create such a relationship is required.

As part of her motion, Shrewsberry argued that an annuitant purchasing a single life annuity is presumed to know that he might pass away before receiving substantial benefits of the policy. Ms. Shrewsberry also pointed towards Plaintiff's own evidence that the professor, who had a PhD and taught in universities for more than 30 years, was capable of understanding the repercussions of her actions, and that she was not too incapacitated to engage in arms-length contractual negotiations. Judge Deborah A. Batts, who presided over the case in Federal court, agreed. She found that no fiduciary duty existed, and dismissed the complaint in its entirety.

In another case, Ms. Shrewsberry represented an insurance broker who was accused of breaching a fiduciary duty. The Plaintiff filed suit against the broker and his attorneys when the Plaintiff's $700,000 life insurance policy lapsed. The policy was originally purchased in 1989, and was owned by an irrevocable life insurance trust (ILIT). In 1999, the ownership of the policy was to be transferred to a second trust. The transfer never took place and, only one year later, the policy lapsed for non-payment of premium. The Plaintiff's poor health prevented him from simply reinstating the policy.

The Plaintiff then filed suit, alleging that the insurance broker, with whom he had a close relationship for 40 years, should have ensured that the change of ownership was effected, and should have prevented the policy from lapsing. Ms. Shrewsberry countered by filing a motion for summary judgment, arguing that there was no fiduciary duty between the broker and the Plaint ff.

Under New York law, an insurance broker has a duty to obtain insurance coverage requested by the client within a reasonable time, or to inform the client of the inability to do so. There is generally no duty to continue to advise the client, as the client is ordinarily in a better position to know his own financial situation and insurance needs. Therefore, the relationship between broker and client is an ordinary commercial relationship, not one involving a fiduciary duty.

Ms. Shrewsberry went on to argue that even though the Plaintiff and broker were longstanding friends, no fiduciary duty existed between the two. Justice Steve Jaeger heard all arguments, and granted Ms. Shrewsberry's motion for summary judgment. Justice Jaeger agreed that, although the insurance broker attempted to facilitate the transfer of ownership of the policy, there was nothing more he should have done. In granting the motion, Justice Jaeger rejected the Plaintiff's claims that the broker should have known when the policy was about to lapse and should have prevented the lapse. Since the ultimate cause of the lapse was the Plaintiff's failure to pay the premiums, the Plaintiff was ultimately responsible.

Both of these cases reflect different ways that the "fiduciary duty" argument is used to assign blame when the purchaser of insurance is actually the responsible party. As both Plaintiffs discovered, New York law clearly spells out that the relationship between an insurer or its representative and the customer does not automatically rise to the level of fiduciary.

The case involving the insurance company was Vera Muller-Paisner v. TIAA-CREF (U. S. District Court, Southern District of New York, Index No. 03 Civ. 6265). The second case was Michael Wolfe v. Tannenbaum, Dubin & Robinson LLP (Supreme Court of the State of New York, Nassau County, Index Number 014600-01).

TELS congratulates Ms. Shrewsberry for these two successes. For more information on Ms. Shrewsberry, a partner with TELS, please visit:

Thousands Sign Petition for Action on HIV/AIDS and Malaria

Thousands Sign Petition for Action on HIV/AIDS and Malaria

Initiative demands free malaria prevention and treatment for people living with HIV/AIDS.

Dakar, Senegal (PRWEB) December 8, 2008

Following the 20th annual World AIDS Day (http://www. worldaidscampaign. org/), global health activists gathered for the International Conference on AIDS and STDs in Africa (ICASA) announced today that nearly 6,000 people from 163 countries signed a petition demanding insecticide-treated nets for malaria prevention for people living with HIV/AIDS, along with other preventative interventions and effective treatment, as an additional part of their health care. Along with the Roll Back Malaria Partnership (http://www. rbm. who. int/), more than 80 organizations and networks of people living with HIV/AIDS also offered their collective support, including the 33 million-member Global Network of Positive People (GNP+) (http://www. gnpplus. net/) and the International Community of Women Living with HIV/AIDS (ICW) (http://www. icw. org/) regional African networks.

"To those of us in Sub-Saharan Africa, especially people like me who are already HIV positive, know that many people living with HIV in our countries are dying from malaria. It is critical that the funding and planning for people with HIV include provisions for malaria protection--and that is why this petition is so important," said Carol Maimbolwa Nyirenda, Alternate Board Member of the Communities Delegation of the Global Fund to Fight AIDS, Tuberculosis and Malaria, and Board Member of the Communities Delegation of UNITAID. According to the latest research, interactions of HIV/AIDS and malaria infections adversely impact both diseases - malaria makes HIV worse and HIV makes malaria worse

The petition draws much-needed attention to the problem of co-infection with HIV/AIDS and malaria, which are the most prevalent infectious diseases in sub-Saharan Africa. Supporters are urging Ministers of Health in malaria endemic countries, heads of agencies of bilateral and multilateral initiatives, donors and an array of other entities to honor their commitments and act jointly on the two diseases. Thousands of activists, academics, implementers, physicians, private sector partners, and people living with HIV/AIDS joined the call for action at the XVII International AIDS conference in Mexico City, prompting a continued effort concluding Saturday in Dakar.

"Many of the four million lives lost to malaria and HIV/AIDS every year could be saved by more effective integrated prevention and treatment programs," said Yvonne Chaka Chaka, Goodwill Ambassador for UNICEF and the Roll Back Malaria Partnership. "If we collaborated more and competed less, we could work toward more innovative solutions that tackle multiple diseases. Campaigns like one I recently took part in offer potential solutions."

Chaka Chaka was among the hundreds of volunteers engaged in a pioneering integrated program last month in rural Kenya. Almost 50,000 people - or more than 80% of the targeted population in the selected region - were tested for HIV in only one week. Tools and techniques for protection from malaria, HIV and water-borne diseases were offered as an encouragement to every participant, while helping move communities beyond the stigmas often associated with testing. The Swiss-based company Vestergaard Frandsen (http://www. vestergaard-frandsen. com/), in partnership with the Kenyan government and civil society organizations, designed and sponsored the campaign and offered their early support to the HIV/malaria petition.

"My company supports this petition because it will draw global attention to the needs of people living with HIV and AIDS to be protected from malaria," said Mikkel Vestergaard Frandsen, CEO of Vestergaard Frandsen. "More importantly, integrated efforts help save lives and reduce suffering among some of the most vulnerable people in the world. I'd like to thank everyone who has supported this petition for adding their names to the growing chorus of people demanding that everyone living with HIV/AIDS also be protected from malaria."

Studies estimate that HIV may increase the clinical malaria by 28% and mortality by 114% in certain countries, while also confirming that HIV-infected adults in malaria endemic areas are at increased risk. Although the consequences of co-infection can be severe for anyone, malaria and HIV interactions are particularly dangerous for pregnant women and children.

The complexity of co-infection demands effective management and strengthening of health care delivery systems. Multiple disease approaches are life-saving, efficient and offer an opportunity to ease the burden on community health care workers and strained health infrastructure.

"It is vital that the HIV/AIDS and malaria communities collaborate to ensure protection and treatment for all who are suffering from these two diseases and protect those who are at risk, like young children and pregnant women," said Prof. Awa Marie Coll-Seck, Executive Director of the Roll Back Malaria Partnership (http://www. rbm. who. int/docs/coll-seck-en. htm), during ICASA. "By forming strong partnerships and joining forces on critical health issues, we can make a huge difference in the lives of millions."

XanGo Distributors Get Recharged at Convention

XanGo Distributors Get Recharged at Convention

Is XanGo the next Google? The iPod of dietary supplements? Rosa Parks in a bottle?

West Mifflin, PA (PRWEB) November 9, 2005

Yes, yes and yes, says company president Aaron Garrity, at least if the common denominator is catalyst for change.

Garrity used the image of the late Civil Rights icon Parks, sitting on a bus in Montgomery, Ala., on Friday to inspire his troops -- 6,000 distributors gathered at the Salt Palace Convention Center for the third annual XanGo convention, the theme of which is Unleash the Power. All are united by a single product: A tasty blend of juice concentrate made from and marketed around the mangosteen fruit of Thailand.

If you've never heard of the Lehi-based company or the supplement it makes, you're not alone. Salt Lake City Mayor Rocky Anderson hadn't until he was asked to welcome the crowd at Friday's opening session. "We just drove down to BYU law school and noticed XanGo's incredible presence at Thanksgiving Point," Anderson said. "It is a company that has just skyrocketed in just three years and along with that is a huge distributor network."

XanGo (pronounced Zango) has more than 400,000 independent distributors worldwide and employs more than 500 workers in Utah. The privately held company won't discuss its balance sheet, but Nutrition Business Journal ranked XanGo's U. S. sales No. 5 - ahead of NuSkin and behind veteran direct sales companies Avon, Alticor (formerly Amway), Mary Kay Cosmetics and HerbaLife.

"We're right up there with the big boys," says spokesman Bob Freeze.

That much is reflected in the spectacle of the two-day convention. Inside a convention center wrapped in XanGo orange, distributors are being treated to Bill Gates-style stage shows -- the company has its own theme song - motivational videos, a huge store of XanGo swag, and a raffle for cash prizes, a XanGo Vespa and a 2006 Ford Mustang GT. Today, U. S. Sen. Orrin Hatch of Utah -- the author of dietary supplement legislation and a rock star in the health-food world - is expected to speak.

This is Justin Banner's first XanGo convention. Before joining the company, Banner earned an MBA from Purdue University and worked at General Electric. "I'd go to their meetings and people don't clap, people don't get excited. . . . The momentum of this company is incredible."

Adds Anderson: "They really crank the crowd up."

This year, the company is launching an online store and taste-testing some new products - XanGo ice cream, a caffeine-free sports energy drink, a chocolate truffle and hard candies, all made in conjunction with Wild Flavors, the German-based company that works with the makers of Capri-Sun and SoBe.

"These aren't two guys who mixed up some potion in their bathtub," said Freeze of founders Joe and Gordon Morton.

But they are celebrities with the orange-clad crowd.

"People come to convention to get recharged, and we see a huge jump in sales immediately after," Freeze said. "But a lot of people come just to get on stage with the founders."

Teresa Tapp's Shape Up Success Pep Talk

Prepare for Success
January 1st is the biggest day of the year for gym membership sign ups and marketing. Suddenly everyone seems to be pumping iron, working out, and eating rice cakes. In truth, by jumping on the January gym bandwagon, people can set themselves up for failure. Tapp notes, "Drastically rearranging your life around a workout schedule may seem like a good goal, but in reality, very few people can make such a radical change and sustain it. Instead, strive to dedicate just 15 minutes day (http://www. youtube. com/results? search_query=teresa+tapp&search_type=&aq=f) to fitness and turn everyday activities into exercises."

Cheat Wisely.
Everybody cheats. The trick is to be smart about it. Tapp says, "Diets of denial don't work, so use some reverse psychology and don't be fixated on what you can't have. If you give yourself a break from guilt, then you won't feel the need to eat the entire bag of chips or box of cookies." Tapp also advocates being good for two days and cheating on the third, along with a healthy session of cardio exercise to offset calorie consumption and ramp up the metabolism.

Throw away the scale.
It's not about a number, it's about how you feel. According to Tapp, "You might be a lot heavier with strong, lean muscles, but you'll find that you drop clothing sizes easily. Focus on being fit and healthy for your body type, not trying to attain some unrealistic number on a scale."

New Years Resolutions don't have expiration dates.
"Everybody falls off the wagon, even me," Tapp states. "That's okay. Every day is the first day of the rest of your life (http://www. t-tapp. com/success). Wake up and move on."

Find a support system.
"Don't be shy - enlist friends and family members to help you maintain and sustain your fitness resolutions," Tapp advises. "You might be surprised at how much your positive attitude will inspire people to make healthy changes in their lives as well."

Fitness begins with your feet.
"Most people don't realize that your big toe is connected to your tummy," Tapp reveals. "When you put mind-to-muscle focus on your big toe, you actually engage your stomach area muscles. Try lifting your knees and pointing your toes. You should feel it in your tummy." For trimming and toning while standing or sitting, Tapp recommends pressing the ball joint of your big toe into the ground and lifting your big toe as hard as you can. The higher the arch of your foot lifts, the more you're activating your abs. Follow with a few quick pointed-toe lifts. Tapp adds that if you're walking, point and flex with each step, putting your weight on your outer three toes while keeping your feet straight, and activate those muscles to circulate lymph, remove cellular waste, and reduce inflammation.

Women to Women Advocates Changing Conventional Medicine's Approach to Managing Menopause Symptoms in Light of New Study

Women to Women Advocates Changing Conventional Medicine's Approach to Managing Menopause Symptoms in Light of New Study

The recent worrisome news that synthetic hormone replacement therapy causes more aggressive forms of breast cancer has led more women - and their doctors - to question the conventional standard of care for menopause symptoms.

Yarmouth, Maine (PRWEB) November 11, 2010

The recent worrisome news that synthetic hormone replacement therapy causes more aggressive forms of breast cancer has led more women - and their doctors - to question the conventional standard of care for menopause symptoms.

"A revision in the standard of care is long overdue," says Marcelle Pick, OB-GYN NP, co-founder of the renowned Women to Women healthcare clinic. "We've had an endless stream of negative studies on HRT since the original WHI study in 2002 showed it raised the risk of cancer, heart disease, and stroke. This latest study is simply the worst."

Unfortunately, the genuinely newsworthy aspect of this study has been lost in the sensationalistic tone of the media which is spreading certain incorrect information. The way the information was reported made it sound like taking hormones of any kind, in any way, increases the risk of breast cancer. This is not true. The women in the study were taking synthetic hormone drugs, which do not have the same qualities as hormones found naturally in the human body.

"The good news is that even long-term defenders of synthetic HRT are now questioning its continued use," commented Dixie Mills, MD, a nationally recognized breast cancer expert. "The number of women using synthetic HRT fell sharply after the WHI study came out, but the pharmaceutical industry has kept promoting HRT as the only alternative, and many doctors have continued to recommend it."

"Our view has always been that synthetic HRT should be the last resort, used by just the tiny percentage of women who don't respond to less risky approaches, and then only for the shortest possible period of time," added Pick.

Mills remarked, "The new standard of care should recommend improved nutrition, phytotherapy, lifestyle, and exercise as first-line therapy to manage menopause symptoms. If that doesn't yield enough improvement, the doctor and patient can try bioidentical hormones. While there aren't enough data to make final judgments about the long-term safety of bioidentical hormones, their efficacy is clear, there is no evidence of unusual risk, and there is a biologically plausible argument that they could be safe when used under a doctor's care with continual monitoring of hormone levels, as should be done with any form of HRT."

"Synthetic HRT should be the last resort," concluded Pick, "as it has been in our practice for most of the last 25 years. On our website we give away for free the information women need to follow the natural approach to balancing hormones first - this has helped millions of women. For those who don't want to undertake so much reading and self-help, we offer a web-based, at-home program. And of course we welcome patients at our clinic who want to wean off synthetic HRT and perhaps try bioidentical hormones instead."

WorldÂ’s First Hot Pepper Nasal Spray Moves into Canadian Retail

WorldÂ’s First Hot Pepper Nasal Spray Moves into Canadian Retail

Sinus Buster hot pepper nasal spray has become perhaps the “hottest” natural health product ever. Known as the world’s first hot pepper nasal spray, Sinus Buster has grabbed worldwide attention from medical researchers, doctors and thousands of patients suffering from chronic sinus, headache and allergy conditions. Growing demand north of the American border has prompted SiCap Industries (makers of Sinus Buster) to initiate a retail rollout to stores throughout Canada.

Albany, NY (PRWEB) May 4, 2005

Sinus Buster hot pepper nasal spray has become perhaps the “Hottest” natural health product ever -- in more ways than one.

“It’s about time we did it. We’re in hundreds of small stores. Most of them in America and some overseas, but nothing in Canada until now. We have so many internet customers from Canada that beg us to get Sinus Buster in stores up there. Canadians complain how the mail system and customs can be pretty slow getting it there and sometimes it just doesn’t make it at all. It'll be so much more convenient for these customers to get their Sinus Buster in local Canadian stores,” says Wayne Perry, president of SiCap Industries.

SiCap had a tough time choosing a distributor for Canada because things above the American border are quite different when it comes to selling natural health products. The Canadian government has far stricter rules for dietary supplements than those of the United States. According to SiCapÂ’s management team, they were holding out for a distributor that not only understood the rules, but also believed in the product.

SiCap Industries recently signed a distribution deal with S&D Enterprises of Alberta. This deal entitles S&D to exclusive distribution rights throughout Canada. That includes retailers (large and small) in every province. S&D will also be launching a website catering to CanadaÂ’s online shoppers at (www. sinusbuster. ca) in the coming months.

“We’ve been approached by a bunch of distributors in Canada, but S&D had the right stuff. I mean they really got the concept of Sinus Buster. They’ve used it and they believe in it, and they understand Canadian law as it relates to natural health supplements. This is a very tough product to promote if you haven’t tried it because everything you read about it seems like pure hype, but it really does work for almost everyone. This stuff puts mainstream headache medicines and sinus sprays to shame. And believe me Sinus Buster lives up to and beyond its' reputation,” adds Perry.

In America, Sinus Buster has become an underground star of the headache and sinus world. Not only does it have a solid reputation for relieving the worst chronic sinus and headache symptoms, but it's also known for promoting healthy sinuses as a dietary supplement. Sinus Buster has received top notch reviews in the Wall Street Journal, ReaderÂ’s Digest UK, Prevention Magazine and numerous NBC, ABC and FOX television news affiliates.

In Canada, Sinus Buster will be marketed with a little less zeal than in the United States, but nonetheless the message will be the same. Sinus Buster has shown itself to be highly effective for relieving a multitude of sinus and headache symptoms for thousands of users. In addition, there are a handful of clinical studies showing Capsaicin, (the active ingredient in hot peppers & Sinus Buster) to be a potential remedy for chronic headaches and a wide variety of conditions involving sick sinuses.

Thus far, Sinus Buster has shown that it may be effective on both bacterial and allergic sinus conditions for a large number of sufferers. Of course this is based largely on anecdotal evidence presented by verifiable patients and physicians, but the testimonials are nonetheless compelling. Sinus Buster has also built a substantial following by the medical research community. There are presently two European clinical trials underway, and two other American trials planned for the coming fall.

The European trials are looking at chronic sinus conditions in one group and (believe it or not), the potential weight loss benefits of intranasal capsaicin in another group. Dozens of positive studies have been done with synthesized Capsaicin, but nothing has appeared to have such notable success rates as the Sinus Buster formula. Therefore researchers are looking specifically at the Sinus Buster formula as opposed to general capsaicin applications based on preliminary studies showing this formula to be more effective than anything synthesized in a lab.

"You have to understand that it’s not just the capsaicin that’s helping these people. It’s the way we’ve combined it with other herbals and the fact that we use natural extracts. This formula is a trade secret that cannot be exactly duplicated, and researchers are beginning to believe our company stumbled onto something that’s medically spectacular. Lets face it, Sinus Buster has been around for more than a year now and we've had tens of thousands of users who consider it almost miraculous,” says Perry.

When the American study launches in a few months, Perry says researchers will concentrate on two groups – one with Allergic Rhinitis and the other with Nasal Polyps. Although the reputation of Sinus Buster is a solid one, these clinical trials are an important step for mainstreaming this emerging medical breakthrough.

“We have hundreds of physicians recommending Buster to their patients. We know it doesn’t work miracles for everyone, but really nothing does. Not even surgery, but I’ll tell you this….Sinus Buster shows more potential than anything else on the market. This formula will stop a migraine or any headache for that matter within minutes for at least 90% of users. And when it comes to sinus infections and allergies, nothing comes close to Sinus Buster. This is a truly all natural product that can do what mainstream cough and cold products can’t. And once the clinical trials are complete, science will back up what our thousands of anecdotal reports already show,” Perry brags.

According to spokespeople for S&D Enterprises and SiCap Industries, Canadian retail interest in Sinus Buster has been brisk from the start with the first shipments being pre-sold to a number of stores. The launch has already begun in Alberta, and if all goes well Sinus Buster will be springing up on the shelves of retailers throughout Canada. Look for Sinus Buster to start hitting Canadian health food shops, supermarkets and pharmacies by the end of May.

To find out more about Sinus Buster hot pepper nasal spray in Canada, call 1-866-705-0680. The Canadian Sinus Buster website is also up and running (www. sinusbuster. ca) although it wonÂ’t be complete for several weeks.

All "Canadian Medical & Media” inquiries should be directed to S&D Enterprises of Alberta at the contact information in the body of this release.

In addition, all "Non-Canadian Medical & Media" inquires should be directed to SiCap Industries in the United States via the contact information that accompanies this release.

PC Health Advisor Launched to Boost PC Performance and Security

PC Health Advisor Launched to Boost PC Performance and Security

ParetoLogic's PC Health Advisor software provides home users with an all-in-one solution for computer optimization, security, and maintenance. After a healthy development period, average PC users finally have access to this multi-function program.

Victoria. B. C. (PRWEB) May 19, 2010

At an official ribbon cutting ceremony at ParetoLogic's head office, company executives unveiled PC Health Advisor to the public. The new software packs a huge number of features and tools to optimize, secure, and maintain Windows PCs. With ParetoLogic's successful track record, indications are that PC Health Advisor (http://www. paretologic. com/products/pchealthadvisor/index. aspx) will help millions of customers and their computers.

"We are absolutely ecstatic about PC Health Advisor and the ways it can help people," said Elton Pereira, ParetoLogic's President, CEO and Co-Founder, at the program launch celebration. "This is the software that our users have been asking for."

PC Health Advisor raises the bar for system utility and optimization software (http://www. pchealthadvisor. com/). Included in the digital multi-tool are a registry cleaner, privacy scanner, and malware process detector. The registry cleaner detects and removes problems in the Windows registry to improve performance, speed and system stability. The privacy scanner locates personal information and then permanently erases it. Computers continually record a user's actions, the files accessed, and websites visited. PC Health Advisor removes this privacy and security risk. The malware process detector, as the name implies, searches for active malware on the system. This ensures that malware does not annoy users with pop-ups, or endanger them with keyloggers or Trojans.

"We've integrated truly essential functions," said Ted Deng, Senior Project Manager at ParetoLogic, "not only are vital optimization features included but we've also added completely new tools and controls."

These tools include direct access to Windows customization options, a process manager, duplicate file finder, Startup Manager, and BHO Manager. The software pairs ParetoLogic's user-friendly interface with an array of technologies that have traditionally been the exclusive domain of highly trained technicians. All told, the toolkit gives Windows users unrestricted control over their computers, and instant power to clean, tweak, and fine-tune them.

"The software is so powerful, but the interface so easy-to-use," said Pereira with a smile, "PC Health Advisor might end up giving some users a reputation as a computer whiz."

About ParetoLogic (http://www. paretologic. com/index. aspx), Inc.

In 2004 four brothers recognized that modern computer users need not rely on computer repair technicians to maintain their own PC's. Knowing that sophisticated technology married with a truly user-friendly interface would empower people to secure and optimize their own computers, the brothers researched the marketplace to define and develop the software products that would most benefit today's computer user.

ParetoLogic now employs 125 professionals to help them research, develop, and market software applications that will enable people to secure and enhance their computing experience. Available in 208 countries around the world, ParetoLogic has established partnerships on a global scale to ensure that its products are available to all computer users, regardless of location, language, or computing experience.

Attention to the needs of the consumer coupled with a commitment to delivering exceptional software applications and resource-rich websites guarantee that our products will exceed your expectations.
