Along the way, you'll get the chance to ride by the Seven Lakes, visit five national parks, take a hike to Petrohue Falls, stop at the Curarrehue Museum and soak in the Huife hot springs. During November and December of 2004, approximately 3,800 patients in Durham and Raleigh, North Carolina, were exposed to toxic contaminants during surgical procedures.

During November and December of 2004, approximately 3,800 patients in Durham and Raleigh, North Carolina, were exposed to toxic contaminants during surgical procedures. This exposure resulted from Duke University Health System hospitals mistakenly using waste hydraulic oil in the instrument sterilization process instead of detergent. Since January of 2005, HensonFuerst has been contacted by numerous victims who were exposed to this waste hydraulic oil.

After considerable effort, victimsÂ’ attorneys were allowed obtain samples of the waste hydraulic oil for testing. The law firms retained an independent materials testing laboratory, wholly unconnected to the Duke University Health System, in order to obtain unbiased results. 

The laboratory results confirm that hazardous contaminants were indeed present in the waste hydraulic oil to which patients were unknowingly exposed.

Used hydraulic oil is classified by the U. S. Environmental Protection Agency as a “regulated waste.” This is because such oil degrades, causing extensive chemical changes, and also becomes contaminated with chemicals and debris from hydraulic equipment.

Independent testing arranged by victimsÂ’ counsel was clearly more exhaustive in scope than tests previously ordered by Duke University Health System officials. The limited test results previously provided by a Duke-retained laboratory were released in an effort to convince patients that their exposure was not harmful. This was misleading as the independent test results reveal a different story.

Independent testing revealed large amounts of visible masses. These masses were made up of metal particles, accumulated over time from wear, and soot-like carbon particles formed as the hydraulic oil broke down. Additionally, anti-wear additives in the oil changed form and released their component substances.  Due to these breakdown processes and the accumulation of foreign particles, the waste hydraulic oil appeared visibly darker in color.

Specific contaminants identified by the independent laboratory include arsenic, lead, cadmium, chromium, nickel, zinc and other metals. Arsenic, cadmium, chromium and nickel are metals that can cause cancer. LeadÂ’s propensity to produce a variety of adverse health effects has made this metal a particular focus in regulatory controls of chemical exposures.

Research regarding a number of the identified metals has documented their potential to increase susceptibility to pneumonia-like illnesses and other infections. Many of the same metals have been associated with allergic reactions and the progression of long-term autoimmune illnesses. Particulate matter, such as that found in the waste hydraulic oil, can trigger foreign body reactions that slow wound healing, and its petroleum components can cause irritation to the skin or other tissue.

This information reveals that patients clearly need further evaluation. Chemical analysis alone does not provide enough information because each individualÂ’s contact with the oil differed. Therefore, it is important for the exposed patients to seek an independent medical evaluation. Now that we have identified the contaminants in the waste hydraulic oil to which patients were unknowingly exposed, doctors and scientists will have specific chemicals to consider as they evaluate the health of their patients.

DataCore Software, the leading provider of storage virtualization software, today announced that its SANmelody software is serving as the foundation of a replication and disaster recovery (DR) plan at Alameda County Medical Center (ACMC) that was orchestrated by DataCore partner Entisys. The IT environment at ACMC was fundamentally based upon products from Dell and EMC as well as virtual machines from VMware. ACMC is comprised of multiple sites and as a county hospital the organization is under a number of budget constraints. Entisys presented the Citrix XenServer and DataCore SANmelody DR solution based upon XenServer, which provides great savings to the medical center. "Instead of buying another EMC product to replicate the SAN, we showed them what DataCore can do and ACMC was able to complete a replication scenario for pennies on the dollar with XenServer and DataCore," said Thad Morrow, Director of Sales, Entisys. "But it is not so much about the cost savings as much as it is a case where ACMC could use DataCore to support a very distributed environment where multiple vendors' products are deployed and make a full-on disaster recovery solution possible."

"ACMC has struggled to maintain a disaster recovery or business continuity plan, and has had to use what was available to us - an existing data center that is thirteen miles away," said Ed Dullard, Chief Information Officer, Alameda County Medical Center. "ACMC had been a longstanding Citrix customer, so for cost savings it was a natural choice to replace VMware for XenServers."

"We had been a Citrix shop, so we jumped at the opportunity with XenServer," said Dave Bennett, Director of Technical Support, Alameda County Medical Center. "We liked the product and did not see any tangible difference between them and VMware. As for DataCore, we started looking at SANmelody at the request of DataCore partner Entisys. This was the best technology we saw for our needs, whereby we could economically leverage iSCSI for the remote site SAN rather than spend a lot more on a Fibre Channel SAN." ACMC is currently deploying the solution. The initial data pool will start at 8TBs.

For the deployment, ACMC chose Dell hardware to run the SANmelody-XenServer solution. From a software standpoint, the solution cost ACMC at least five times less than a comparable, proprietary hardware SAN. The choice was more than just money, however; it was about flexibility. With DataCore ACMC does not have to worry about matching up machines, nor did they have any issue with the replication software being able to "talk" between disparate hosts. This ease of use and manageability was just as important as upfront cost savings because the IT staff at ACMC is already spread thin, wherein eight IT people support 2,600 users.

The mission of the medical center is to maintain and improve the health of all County residents, regardless of ability to pay. There are six campuses comprising ACMC, including the main hospital and trauma center in Oakland, California, another hospital in San Leandro, California, provides rehabilitation and extended care, a psychiatric hospital in the same location and three ambulatory clinics. In terms of the IT architecture, all of the campuses are linked via a high speed ATM providing 65 MBs of bandwidth.

Two years ago ACMC purchased and deployed a SAN from EMC. "That was the first step we took in order to consolidate storage rather than using individual servers," explained Bennett. "As such it was the first step down this path." Since then, Dave and his team have taken a different look at the way they store data as well as what is stored, particularly in terms of putting a premium on both data and systems recovery. The organization used VMware in conjunction with its EMC SAN. With DataCore, both VMware and XenServers are in place currently - although longer-term the plan is to standardize on XenServer. "The cost difference between VMware and Xen is pretty substantial," Dave added. "As for DataCore, I could see some real advantages in using DataCore in our environment."

Chiefly, Bennett and his team were sold on SANmelody's ability to first and foremost enable them to utilize existing server storage that was not being used, thereby eliminating the need to go out and buy new disk space. Performance was another key selling point. As for price, Bennett comments, "The price was right. SANmelody just made sense when you put the whole thing together - being able to use existing storage where possible and the performance increases we saw firsthand."

The disaster recovery site at the secondary location in Fairmont will enable ACMC to avoid going to tape back-ups. With the DR site, the IT team can pull data right away and pull whole systems up if necessary when the ones at the primary location go down. "Before this, our whole DR plan revolved around just how fast we could get servers and software available to rebuild them," explained Wright Lassiter, CEO, Alameda County Medical Center. "With virtualization technology as it is today, it makes sense to be able to bring systems and data over from another site when the situation dictates that."

ACMC is taking the classic virtualization approach. They have physical servers, which will be virtualized and then replicated on virtual machines. The VMs with those changes will then be replicated to ACMC's Fairmont site and available in the case of any calamity. "DataCore made this project very achievable for a variety of reasons," summarized Morrow. "A real win for DataCore was the simplicity of the technology. Sure SANmelody is affordable, but more than anything DataCore technology is effective. Additionally, the IT staff at Alameda County Medical Center could implement SANmelody quickly, as well own, manage and grow the solution very easily without the need for professional support."

International association offers tips on how to avoid pitfalls in information management.

Making headlines can be a good thing - unless it's because an organization has mishandled its sensitive records and information. Just ask Affiliated Computer Services, Radio Shack, TJX, the most recent examples of this apparent phenomenon.

 On April 9, the Georgia Department of Community Health announced that Affiliated Computer Services confirmed the loss of a CD containing personal data of 2.9 million Medicaid and PeachCare for Kids™. The data was presumably not encrypted and included personal, identifying information - including full names, birthdates, and Social Security Numbers.  On April 2, the Texas State Attorney General filed suit against Radio Shack Corp. (to be heard in the district court of San Patricio County, Texas, case number S-07-5333CVC) because employees at one of its stores dumped bulk records containing unencrypted personal, identifying information for thousands of customers in garbage receptacles behind the store. Radio Shack could face fines of $50,000 per incident, plus civil penalties of up to $500 for each abandoned record. It's being called the biggest financial breach ever.

The costs of such incidents can be devastating, not only financially but also in terms of customer trust.

"The only protection any company has against these types of occurrences is a well-developed, enterprise-wide records and information management program," states Marilyn Bier, Executive Director of ARMA International, a not-for-profit association and authority on managing records and information. Not only do the policies and procedures have to be in place and well documented, adds Bier, but there must be adequate training throughout the enterprise.

So how do you ensure your company doesn't suffer a similar fate as these and many other companies (remember Bank of America, Choice Point, DSW)? Here are some important steps to take today:

Form an information management compliance team. In today's information-centric enterprise, compliance requires that Legal, IT and RIM all be at the table. No one department can provide a complete solution to ensure your company is compliant with current regulations, effectively protecting its data, and ready for electronic discovery in case of litigation. Assemble a team from these and other key compliance-related areas to work together to assess the organization's potential risks and identify the policies, processes, and technology required to address them.

Assess your current program's potential risks. Before you can identify solutions, you need to know what the problems are. You need to find out where your current records and information management program is vulnerable. Do you know what information you have, where it's located, and how to retrieve it? Particularly your e-mail and other electronically stored information (ESI)? Recent changes to the Federal Rules of Civil Procedure specifically establish this expectation. There are online self-assessment tools available specifically designed to help you determine where you are at risk. Evaluate your e-mail management policies. E-mail continues to challenge organizations. With the growth of e-mail, voice-mail, and instant messaging - as well as other electronic records - the capacity for discoverable information has increased. This month, create or review your company's electronic records policies. Pay particular attention to your e-mail retention policies emphasizing retention based on the content of the messages, not the application. For best results, this will be done in collaboration with the rest of the compliance team.

Update and document your policies and procedures. Once you've performed your self-assessment, you should have a good idea as to which policies and procedures need to be developed or updated. There are a number of resources available to help you in this effort, including various standards and guidelines. That's one of the things courts look for: do you have a policy and did you follow it?

Take the time to train: Individual employees play a critical role in helping your organization comply and succeed in litigation, audits, document preservation, and daily records and information management tasks. If you don't have an enterprise-wide training program that is delivered at least annually, now's the time to implement one. One of the expectations put forth in the new federal rules is that all employees are trained on how to appropriately manage electronic information. Securing that information should be part of that training, as well. ASTM C-518 (insulation value): R-value of R16- R20 depending on model and thickness (10 inch standard is R19).

ASTM E-136 (fire/combustibility): Fire test by DIRECT torch punishment for over 4 hours: Application of a direct flame from a propane blow torch (Blue flame) to Earthblock surface will not cause combustion. When the torch is removed, even after minutes, Earthblock will not support combustion and cools off quickly, showing only mild surface roughage and discoloration where the flame was DIRECTLY applied to the block. Earthblock will revolutionize the way that the Insurance Industry looks at future policies and can make lumber/concrete block obsolete in the construction of residential and commercial structures. Hot "oven" test: This test introduced small cube Earthblock samples to temperatures of 750º C. Since this is well above the combustion temperature of wood, the samples began to make a sizzling sound, due to embedded sawdust. However, the samples hold their structure and do not collapse. This indicates that full-size Earthblock would have to be DIRECTLY EXPOSED to a long period of extreme heat of over 750º C (At least 4.5 hours +) to induce combustion or total structural failure.

ASTM C-67 (strength and shock absorbency): Direct hammer blows: Direct blows with a hammer only cause small dents and external surface damage to an Earthblock. Earthblock will not break/shatter in pieces as concrete does. Earthblock absorbs the blows beautifully. With repeated manic-power-blows, you can obviously create local hairline fractures here and there and also cause eventual fragmentation, but only after more powerful hammer-blows, with the same exact hammer, that you can shatter any concrete block with on just ONE BLOW (Grab a hammer and a concrete block and you'll see for yourself). Earthblock proved its superiority in a proud and efficient manner. It proves its seismically superiority and uniqueness.

ASTM C-140 (compression load): Ratings in the 500 - 700 psi range. This makes Earthblock handle much more weight loaded than concrete block is able to handle. This proves that Earthblock's load bearing capabilities surpass the concrete blocks easily and effectively. (Ex: 250-300 psi is the minimum for adobe block.)

ASTM C-666 (weathering): Immersion in water and 200+ freeze-thaw cycles caused no loss of internal or structural integrity. Only minor surface damage due to the extreme punishment caused by the test. Under water: Earthblock samples absorb water and also lose it through wicking. However, this causes no swelling or weakness in Earthblock. Samples with our water-repellent additives almost double in strength after soaking and drying. Even soaked samples maintain their strength beautifully. Soaked samples scored from 500 - 1,000 psi.

For the first time in the nation, a guidebook exists to help those who help homeless women to increase these women's chances for safety and to reduce their risks for assault on the streets.

WHY: According to Boston's most recent homeless census, the number of homeless women living on the streets is growing faster than that of all other groups. Violence from their partners and others, including sexual trauma, is a common thread that twists their lives from bad to worse. Moreover, physical and sexual assault deceases a homeless woman's likelihood of moving into permanent housing.

Enabling homeless women, often substance-dependent and traumatized, to plan for their own best interests sounds like a tall order. Any guidance needs the best wisdom and input from service providers and public agencies from the fields of domestic violence, sexual assault, addiction treatment, law enforcement, health care and homeless services. This new guidebook reflects the expertise of these providers and also the insight and voices of homeless women themselves.

WHO: The Women's Violence Prevention (WVP) Alliance, a pioneering coalition convened by Friends of the Shattuck Shelter and funded by Mellon New England/Alice P. Chase and Peter E. Strauss Trusts, brings together 20 such agencies to connect their services, identifying and addressing gaps. The intent: to change the way Boston providers work with homeless women to enhance their safety, sobriety and over time, the ability to secure permanent housing.

WVP searched the nation for a step-by-step guidebook that would help service providers, no matter their specialty, counsel homeless women on their many intermingled problems. No such book existed. Now it does. At the upcoming breakfast event, WVP will present to its members and civic officials the new Safety Planning Guide "Keeping Safe on the Streets," full of concrete, realistic suggestions to keep Boston women alive, healthier, safer, and a little less traumatized. It's not the solution, but it's a key first step. The Guide is designed to be easy to reprint and adopt in cities across the country.
